Golding & Golding Gets Client a Full Waiver of an OVDP Penalty
We are pleased to announce that Golding & Golding successfully had a client removed from the OVDP penalty structure, with no penalty issued.
We worked closely with the IRS Agent assigned, who was very fair and understood our client was pushed into OVDP by inexperienced prior counsel.
Background
Of course, it’s the same old story. Inexperienced counsel (this attorney had less than 10 years of private practice experience and no Enrolled Agent or CPA credential), convinces the client to go OVDP.
The attorney sells the client on IRS voluntary disclosure experience he or she does not have (handling a few Streamlined Cases and calling yourself an expert or specialist…makes you neither a specialist nor an expert).
The client was non-willful and did not require OVDP. The attorney gave the client incorrect information, and the client was unnecessarily stuck in OVDP.
The client came to us, quite upset. We immediately identified the problems and found a tailored strategy to successfully help her.
We got the client out of OVDP and she lived happily ever after.
